2. Hosting and Delivery (Cloudflare)
This website is operated on the platform of Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA ("Cloudflare") (Cloudflare Workers, content delivery network). When you visit it, Cloudflare processes technically necessary data, in particular your IP address, date and time, the requested address, the previously visited page (referrer) and browser and operating system details. This is required to deliver the website and to protect it against attacks.
The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in secure, fast and reliable delivery. We do not store IP addresses ourselves. A data processing agreement pursuant to Art. 28 GDPR is in place with Cloudflare. Cloudflare is based in the USA and certified under the EU-US Data Privacy Framework; an adequacy decision of the European Commission therefore applies (Art. 45 GDPR).
Download counting: When you click "Download", we only increment a counter per day and version. We store neither IP addresses nor browser details or any other personal data.
3. No Cookies, No Profiles
This website sets no cookies and does not use advertising networks, social-media tracking or analytics services that recognise visitors or build profiles (e.g. Google Analytics). For aggregated visitor statistics without cookies we use Cloudflare Web Analytics (section 3a).
We only store something in your browser's local storage (localStorage) in two
cases, and only once you act yourself: the colour scheme you chose with the light/dark switch
(upsmonitor-theme), and the time the contact form was last sent, as protection
against repeated submissions (ups_contact_ts). Both entries stay in your browser,
are not transmitted to us and can be deleted at any time in your browser settings. Legal
basis: § 25(2) no. 2 TDDDG (strictly necessary for the function you requested).
3a. Visitor Statistics (Cloudflare Web Analytics)
To understand how this website is used, we use Cloudflare Web Analytics (Cloudflare, Inc.,
see section 2). The page loads a small script from static.cloudflareinsights.com
for this. The service sets no cookies, uses no local storage and builds no user profiles;
individual visitors are not recognised. It records aggregated data such as pages viewed,
referrer, country, browser, device type and load times.
The legal basis is Art. 6(1)(f) GDPR (legitimate interest in measuring reach and improving the
website) and § 25(2) no. 2 TDDDG. You can prevent the collection by blocking JavaScript or
requests to cloudflareinsights.com in your browser.
4. Contact by E-Mail
If you contact us by email, your details (email address, name, and message content) are stored to process your enquiry. The legal basis is Art. 6(1)(b) GDPR (pre-contractual measures) or Art. 6(1)(f) GDPR (legitimate interest). Your data will not be passed on to third parties and will be deleted after the matter is concluded, unless statutory retention obligations apply.
4b. Contact Form
If you use the contact form at upsmonitor.de/en/contact.html, your details (name, email address, category, and message) are transmitted to us via the service web3forms (web3forms.com). web3forms processes form data on servers in the EU. Legal basis: Art. 6(1)(b) GDPR (processing your enquiry). For further information, see the web3forms privacy policy: web3forms.com/privacy.
4c. Version Display and Checkout (GitHub, Polar)
When you load this website, your browser automatically queries GitHub's public releases API
(api.github.com/repos/surdr25/upsmonitor-releases) to display the current
version number, file size, and checksum. This transmits your IP address to GitHub, Inc. No
cookies are set. Legal basis: Art. 6(1)(f) GDPR (legitimate interest in an accurate, up to
date version display). Further information:
GitHub Privacy Statement.
Purchases via Polar: Polar (Polar Software Inc.) is our reseller (Merchant of Record). Only when you click a buy button does the page load Polar's checkout script (from our own server) and open Polar's purchase form as a window on this page. From that click on, Polar processes your IP address and all payment and billing data directly and under its own responsibility, not us. Polar and its payment providers may set cookies that are technically necessary for the payment. No data is sent to Polar before the click. Legal basis: Art. 6(1)(b) GDPR (pre-contractual measures). Further information: polar.sh/legal/privacy.
5. Licensing System (Software)
When activating a licence for UPS Hyper-V Shutdown Monitor, the following data are processed through the licence management of our service provider Polar (Polar Software Inc., see section 4c):
- Licence key
- Hardware ID of the activating device (anonymised fingerprint)
- IP address at the time of activation
- Activation timestamp and expiry date
- Optionally: customer name and email address (for invoicing)
Legal basis: Art. 6(1)(b) GDPR (performance of contract — licence verification and management). Data are stored for the duration of the licence agreement and deleted thereafter.
The software automatically connects to the licence server on start-up to verify licence validity, transmitting the hardware ID. A connection to the licence server is only required when an internet connection is available; offline operation is possible for a limited period.
To check for updates, the software downloads a version file from GitHub (github.com/surdr25/upsmonitor-releases). This only transmits your IP address to GitHub, Inc.; no data from the application is sent. Alternatively, your own update source (UNC path or HTTPS server) can be configured. Legal basis: Art. 6(1)(b) GDPR (provision of updates).
All other data of the software — measurements, reports, configuration, credentials, logs — is stored exclusively on the customer's machine and is not transmitted to us. There is no telemetry. The software only sends alerts over channels the customer sets up themselves.
6. Your Rights
Under the GDPR you have the following rights:
- Access (Art. 15 GDPR): What data we hold about you
- Rectification (Art. 16 GDPR): Correction of inaccurate data
- Erasure (Art. 17 GDPR): Deletion of your data
- Restriction (Art. 18 GDPR): Restriction of processing
- Data portability (Art. 20 GDPR)
- Objection (Art. 21 GDPR): Objection to processing
To exercise your rights, please contact:
You also have the right to lodge a complaint with the competent data protection supervisory authority.
7. Data Security
All connections to this website and to the licence server are encrypted via HTTPS/TLS. Locally stored licence data are encrypted with Windows DPAPI (Data Protection API) and bound to the activating machine; they cannot be decrypted on any other machine.
8. Currency of This Policy
This privacy policy is currently valid and dated September 2026. Further development of the website or software, or changes to legal requirements, may make it necessary to update this policy.
